These Terms of Service ("Terms") govern your use of the website located at www.kubernyx.com and the services offered by Kubernyx, LLC ("Kubernyx," "we," "us," or "our").

Services

Kubernyx provides the following types of services:

• Cybersecurity consulting — Strategic cybersecurity guidance, risk assessments, and advisory services tailored to your organization.
• Fractional CISO services — Embedded senior security executive services on a part-time or fractional engagement basis.
• Compliance readiness reviews — Evaluation of your security posture against frameworks including SOC 2, ISO 27001, and cyber insurance requirements.
• Software products — Business software applications including ReceiptStream.AI and future products developed by Kubernyx.

The specific scope, deliverables, and pricing for consulting engagements are defined in separate written agreements or statements of work executed between Kubernyx and the client. These Terms apply to all such engagements unless otherwise superseded by a more specific written agreement.

Consulting Services — No Warranty

Kubernyx provides consulting advice, recommendations, and assessments based on information available at the time of engagement and the professional judgment of our team. However:

• Consulting advice is provided "as is" and does not constitute a guarantee of any particular security outcome.
• The client retains full responsibility for their organization's security posture, security program implementation, and compliance status. Kubernyx's role is advisory.
• Implementation of any security recommendation is solely at the client's discretion and under the client's control.
• Kubernyx does not warrant that following our recommendations will prevent any specific security incident, breach, or regulatory finding.

Nothing in our consulting deliverables constitutes legal advice. For legal matters, clients should engage qualified legal counsel.

ReceiptStream.AI

ReceiptStream.AI is a software product developed and operated by Kubernyx, LLC. Use of the ReceiptStream.AI application is governed by its own separate terms of service and privacy policy, available at app.receiptstream.ai.

ReceiptStream.AI is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted availability. Users of ReceiptStream.AI should refer to the application's own terms for full details of service terms, payment terms, and usage policies.

Website Use

You agree to use this website only for lawful purposes. You may not:

• Attempt to gain unauthorized access to any part of our website or systems
• Use automated tools to extract content from this website without our permission
• Transmit any harmful, unlawful, or disruptive content through our contact form or any other means

• Any consulting advice, recommendation, or assessment provided by Kubernyx
• Any security incident, breach, or regulatory action affecting your organization
• Any interruption, error, or defect in our software products

In all cases, Kubernyx's total aggregate liability arising from or related to any consulting engagement shall not exceed the total fees paid by the client to Kubernyx in the three (3) months immediately preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain liabilities. In such cases, the above limitations apply to the fullest extent permitted by law.

Indemnification

You agree to indemnify, defend, and hold harmless Kubernyx, LLC and its members, officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your violation of these Terms; (b) your use of our website or services; or (c) your violation of any third-party right.

Third-Party Links

Our website may contain links to third-party websites, including Google Calendar, LinkedIn, and app.receiptstream.ai. These links are provided for convenience only. Kubernyx has no control over the content or practices of third-party sites and assumes no responsibility for them. Accessing third-party links is at your own risk.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the state and federal courts located in Sheridan County, Wyoming.

Dispute Resolution

Before initiating any formal legal proceeding, you agree to contact us at info@kubernyx.com to attempt to resolve the dispute informally. We will make a good-faith effort to resolve the matter within 30 days of receiving written notice.

Kubernyx reserves the right to update or modify these Terms at any time. We will indicate the effective date of any revision by updating the "Last updated" date at the top of this page. Your continued use of our website or services following any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

Severability
